Palm Beach Roadside Services
Service Authorization, Release of Liability and Hold Harmless Agreement
1. Authorization to perform service
I authorize Palm Beach Roadside Services ("PBRS", "we", "us") and its technicians to perform the roadside service I selected in my request (which may be a jump start, tire change, fuel delivery, lockout assistance, or winch-out) on the vehicle I described, and to take the reasonable steps needed to perform that service.
2. I own the vehicle or am authorized
I confirm that I am the owner of the vehicle, or that I am authorized by the owner to request and approve service on it. I confirm that the information I give, including the vehicle and fuel type, is accurate. For lockouts and other services, the technician may ask for ID or proof of ownership and may decline service if it cannot reasonably be confirmed.
3. Risks I understand and accept
I understand that roadside services carry risks even when they are performed carefully, and that older, worn, damaged, or defective parts are more likely to fail. These risks include:
- Jump starts: electrical problems, including damage to the battery, alternator, starter, fuses, wiring, computers, or other electronic modules, especially when the battery or electrical system is already weak, damaged, or faulty.
- Lockout assistance: scratches or damage to paint, door locks, window glass, window seals and weatherstripping, door panels, or interior trim caused by entry tools.
- Tire changes: damage to or problems with wheels, rims, hubcaps, lug nuts, lug studs, wheel locks, or tire pressure monitoring (TPMS) sensors, especially parts that are seized, rusted, or over-tightened; and the condition and safety of a spare tire I provide. I am responsible for having lug nuts re-checked and the spare inspected by a tire shop.
- Fuel delivery: problems with the fuel system or engine, including problems caused by a wrong fuel type or by inaccurate information I give about the vehicle or fuel, and problems caused by the vehicle having run out of fuel.
- Winch-outs: damage to bumpers, body panels, undercarriage, suspension, frame, tow points, tires, or wheels, and to the ground, landscaping, or other property, while winching or pulling a vehicle out.
- Any service: pre-existing wear, rust, prior damage, or defects that may be revealed or made worse during the service.
4. Release and hold harmless
To the fullest extent permitted by Florida law, I release, waive, and agree to hold harmless PBRS and its owners, employees, technicians, and agents (the "Released Parties") from any and all claims, demands, losses, and liability for damage to the vehicle, its contents, or other property that arises out of or happens in the course of the services, including damage caused by the ordinary negligence of the Released Parties.
This release does not apply to damage caused by the gross negligence or willful misconduct of a Released Party, and it does not waive any right that cannot be waived under Florida law.
5. Electronic signature
I agree that checking the box, typing my full name, and signing below is my electronic signature, that it has the same legal effect as a handwritten signature under applicable law, including Florida's Uniform Electronic Transaction Act, and that this agreement is binding on me. PBRS keeps a record of this agreement with my request, including my typed name, signature, the date and time, my IP address, and my device and browser information.
6. General
This agreement is governed by Florida law. If any part of it is found unenforceable, the rest stays in effect. I have read this agreement, I understand it, and I am signing it voluntarily. If I do not agree, I should not submit the request and can call 561-528-4810 to discuss my options.
